The conflation of homosexuality with child abuse was a central issue for the people who ran the Prop 8 campaign, hence the ads that focused on the threat that gays posed to children. Since this plays on the oldest blood libel against gays, it certainly implies that the Proposition was motivated by prejudice. Imagine a Proposition that argued that Jews should be denied, say, being school-teachers because of the threat to the kids. It’s the fourth day of the federal Prop 8 trial and more experts brought in by the plaintiffs (two gay couples) will go on the stand. Here’s a quick recap of yesterday, thanks to the Courage Campaign’s live blog:
George Chauncey, PhD, a professor at Yale University and expert on the history of discrimination against gays, continued his testimony from Tuesday afternoon. The most explosive portion came during the redirect examination by plaintiff-intervener San Francisco Deputy City Attorney Therese Stewart brought in a videotaped deposition of Prop 8 proponent William Tam from December 1st, 2009. The defense strenuously opposed it’s introduction, but Judge Vaughn Walker let it in because Tam was an official proponent of the measure. In the third day of testimony in the Proposition 8 trial in San Francisco, attorney Ted Olson argued that animosity against gays and lesbians was a driving factor in the law.
The Supreme Court has ruled that animus against a group is not a legal basis for forming a law.
As evidence, they showed a video deposition of Hak-Shing William Tam. He sent a letter to Asian Americans claiming that legalizing same-sex marriage would lead to legalizing underage sex. Tam is one of the plaintiffs and tried to withdraw from the case this week.
Tam wrote a letter to Asian-Americans encouraging them to vote in favor of Prop. 8. He wrote that voting for gay marriage was the same as legalizing prostitution and could lead to legalizing underage sex.
In his opening statement, Olson said, “Proposition 8, and the irrational pattern of California’s regulation of marriage which it promulgates, advances no legitimate state interest. All it does is label gay and lesbian persons as different, inferior, unequal, and disfavored.”

Once-hostile media images have been replaced by sympathetic portrayals in such productions as the movie “Brokeback Mountain” and the TV show “Will & Grace,” Thompson said. Labor unions, a “growing number of churches” and many political leaders support gay rights, he added.
The witness, Yale history Professor George Chauncey, replied that gays and lesbians have gained greater acceptance but “continue to encounter tremendous hostility.”
Prop. 8’s opponents sought to illustrate that hostility with their pretrial deposition of William Tam, a San Francisco chemical engineer and activist who was one of the ballot measure’s official proponents.
Tam, who organized rallies and raised money for the measure, sent a letter to Prop. 8 supporters during the campaign warning that if same-sex marriage remained legal, “other states would fall into Satan’s hand.”
San Francisco’s government, already “under the rule of homosexuals,” would move next to legalize sex with children and prostitution, Tam said.
